Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites, applications, content, and services (collectively, the "Services") provided by RaceProof, owned and operated by Holden Comeau, doing business as Half Wheel ("RaceProof," "we," "us," or "our"). By accessing any RaceProof website or service, you agree to be bound by these Terms.

The Services include the websites at raceproof.app, join.raceproof.app, and torque.raceproof.app, the RaceProof application platform, the Torque data publication, and all associated content, APIs, and functionality.

1. Intellectual Property

    RaceProof, Torque, Power Threshold Array (PTA), and all associated marks, names, logos, methodologies, and content are the exclusive intellectual property of Holden Comeau and Half Wheel. All rights are reserved. No license, implied or otherwise, is granted to any intellectual property by these Terms except as explicitly stated below.
  

1.1 Proprietary Methodology

The Power Threshold Array (PTA) is a proprietary analytical methodology developed by Holden Comeau. This includes the PTA framework, the PTA model, the PTA curve, PTA value, the individual Power Threshold designations (PT1 through PT7), the bioenergetic threshold detection algorithms, the variable-density sampling methods, and all derivative analytical techniques, scoring systems, and computational approaches. These constitute trade secrets and proprietary know-how of RaceProof.

The following are claimed as trademarks of Holden Comeau / Half Wheel, whether or not formally registered:

PTA ™ (in the context of cycling fitness analytics)
Proof Network ™
Effort Signature ™
Trust Score ™ (in the context of the RaceProof platform)

1.2 Content & Publications

All content published through Torque (torque.raceproof.app), including data analyses, visualizations, dashboards, research narratives, charts, and written commentary, is copyrighted material owned by Holden Comeau / Half Wheel. This content may not be reproduced, distributed, modified, or used for derivative works without prior written permission.

Brief quotation for the purpose of commentary, criticism, or academic citation is permitted provided that the source is attributed to "RaceProof / Holden Comeau" and a link to the original content is included.

1.3 Software & Platform

The RaceProof platform, including all software, algorithms, scoring methodologies, data processing techniques, device identification methods, trust scoring components, cross-source matching algorithms, user interface designs, and documentation, is the exclusive property of RaceProof. No right, title, or interest in any RaceProof technology or intellectual property is granted by use of the Services.

1.4 Data Outputs

Any data outputs, scores, metrics, visualizations, trust signals, effort signatures, or analytical results produced by the RaceProof platform constitute derived works owned by RaceProof. Users may share their own trust profiles and activity results through the platform's sharing features, but may not extract, scrape, or systematically collect platform outputs.

2. Use of the Services

2.1 Permitted Use

You may access the public portions of the RaceProof websites for informational purposes. You may use the RaceProof application platform in accordance with your account terms and any applicable Beta Participation Agreement.

2.2 Prohibited Conduct

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code, internal logic, algorithms, methods, or architecture of any RaceProof service or methodology
Use any RaceProof intellectual property, methodology, or analytical approach to develop, improve, or contribute to any competing product, service, or methodology
Scrape, crawl, or systematically access the Services by automated means
Reproduce, distribute, or create derivative works from RaceProof content without written permission
Remove, alter, or obscure any intellectual property notices, trademarks, or attributions
Use the Services for any unlawful purpose

3. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. RaceProof does not warrant that the Services will be uninterrupted, error-free, or free of harmful components. RaceProof makes no guarantees regarding the accuracy, reliability, or completeness of any data, scores, or analyses.

4. Limitation of Liability

To the maximum extent permitted by law, RaceProof shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, resulting from your access to or use of the Services. In no event shall RaceProof's total liability exceed one hundred dollars ($100).

5. Beta Program

If you participate in the RaceProof beta program, your participation is additionally governed by the Beta Participation Agreement, which includes confidentiality obligations, terms of service, and privacy provisions specific to beta access. In the event of conflict between these Terms and the Beta Participation Agreement, the Beta Participation Agreement controls for beta participants.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Commonwealth of Pennsylvania.

7. Changes to These Terms

RaceProof may modify these Terms at any time. Material changes will be posted to this page with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
